] Charles has sole custody of sons and will have it as long as it cannot be proved that he is a bad father. No matter what the Earl Spencer had to say, he has no right to the young princes. It's not likely that he will seek custody, however, even when things were at their bitterest, Diana always said that Charles is an excellant father and much more affectionate to their sons than Charles' father ever was to him.
Not to mention the fact that the Earl of Spencer currently lives in South Africa (with his girlfriend, while his wife also lives there in a separate house with their four children!).
