A Question about Scots Law

This really has nothig to do with JA at all, but that question about JP's and Magistrates got me thinking. Does anyone know if , in Regency Scotland, the position of Procurator Fiscal was as it is now, and if someone could be re-tried for the same crime if the original verdict was 'not proven'?
I suppose that's two questions, isn't it? ;-)
