Inheritance and Legitimacy

This question came to mind after watching "Tom Jones". Would Mr. Blifil naturely be Squire Allworthy's legitmate heir because of his birth? i.e.: Just because Tom is the older nephew, would it have affected Mr. Blifil's claim?
