High waists began at least a few years before 1800. And whether or not it was a "Josephine" or "Empire" waist really doesn't matter. The high waist, whether it appeared just before or just after "Empire" would still be referred to as "Empire" just to make things more simple. Just as the Regency period, which is from 1811 to 1821? generally refers to about 1800 to George IV entire reign as king. In some instances this is not the case, but when you are referring to social customs, clothing, foods, etc., they tend to clump them altogether.
