Big deal, Disney owns Miramax, and it had tons of films up for various Oscars.
Ahem - Miramax produces independentish films, unlike its parent and sister companies. The Best Picture Category - which is considered the most important - was saturated this year with small-time sorts of films, if I remember correctly. Jerry was the only studio film up there. So, as you can see, there wasn't any more room for yet another marginal production in the running.
Also, note that Emma and English Patient were both up for best costume.
Best costume is a lesser category. Period pieces - which usually get this award - are relatively few and far in between.
The bottom line is this - AMPAS isn't governed by an equal protection clause. Even if it were, I don't think Emma, as much as I liked it, deserved to be up there.
