Perhaps his sister was married to a French citizen: she wouldn't have much difficulty staying in France.

JA's cousin, the fascinating Eliza Hancock, married a Frenchman named de Feuillide, (though in her case there would have been problems in staying, since he was guillotined in the Reign of Terror): she later married Jane's brother Henry. Eliza was the god-daughter and probably illegitimate daughter of Warren Hastings.

There are a number of lurking similarities between the fictional Brandon and real Warren Hastings, all very slight and probably Austen family in-jokes. As well as the fact that they were both in India, Hastings's house was at a place called Daylesford. Giving Brandon a French connection is probably another one.
