...so I will take your word for it that the legislation and case law of the time forbade taking the lower rate.

But, as far as I can tell we do not know what tax rate Mr Bennet is paying on the horses. So quite possibly Mr Bennet is declaring the houses to be kept for pleasure and paying the higher tax rate, while using them on his farm. So I still don't think we can conclude anything about Mr Bennet's honesty.
