This puzzled me, too, as it is made clear in chapter 1 that Sir Walter would not have disposed of the estate even if every acre had been alienable (footnote says this means it is prevented by legal restriction from being sold). I'm no lawyer, but it would seem odd that this restriction would only apply for Sir Walter's lifetime; I would think that the estate went with the title.
However, Mr. Elliot's flippant words at age 23 may have nothing to do with the legal reality of the situation.
